SCILIXIR operates this store and website, including all related information, content, features, tools, products and services, to provide you, the customer, with a personalised shopping experience (the “Services”). SCILIXIR is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when using the Services. Please read them carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

All product descriptions may change at any time without notice, at our sole discretion. We may discontinue any product at any time and limit quantities offered to any person, geographical region or jurisdiction on a case-by-case basis.

SECTION 3 – ORDERS

When you place an order, you make an offer to purchase. SCILIXIR DERMA ROLLER reserves the right to accept or decline your order for any reason, at its discretion. Your order is not accepted until SCILIXIR confirms acceptance. We must receive and process your payment before accepting your order. Please review your order carefully before submitting it, as SCILIXIR may be unable to accommodate cancellation requests after acceptance. If we decline, modify or cancel an order, we will attempt to notify you using the email address, billing address and/or telephone number provided with the order.

Purchases may be returned or exchanged only in accordance with our Refund Policy. You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when the order is placed and shown in your order confirmation email. Unless otherwise stated, displayed prices exclude taxes, shipping and handling charges and customs or import charges.

Online prices may differ from prices in physical stores or online or other stores operated by third parties. We may offer promotions governed by terms separate from these Terms. If promotion terms conflict with these Terms, the promotion terms prevail.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases. You agree to promptly update your account and other information, including email address, credit card numbers and expiry dates, so that we can complete transactions and contact you as needed.

You represent and warrant that the credit card information you provide is true, correct and complete; you are duly authorised to use that card for the purchase; charges will be honoured by your card issuer; and you will pay all charges at the displayed prices, including shipping and handling and applicable taxes.

SECTION 5 – SHIPPING AND DELIVERY

We are not responsible for shipping and delivery delays. All shipping times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs processing or events beyond our control. Once products are transferred to the carrier, title and risk of loss pass to you.

You may have access to third-party tools through the Services that we do not monitor, control or influence. You acknowledge that access is provided “as is” and “as available”, without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third-party tools.

Any use is entirely at your own risk and discretion. You should ensure that you understand and approve the terms on which the relevant third-party providers supply those tools. SCILIXIR is powered by Shopify, which enables us to provide the Services. However, sales and purchases in our store are made directly with SCILIXIR. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and SCILIXIR, including injury, damage or loss arising from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to your purchases and transactions with SCILIXIR.

SECTION 10 – PRIVACY POLICY

All personal information collected through the Services is subject to our Privacy Policy, and some information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Your Feedback must not violate third-party rights, including copyright, trademark, privacy, personality or other personal or proprietary rights. It must not contain defamatory, unlawful, abusive or obscene content, viruses or other malware that could affect the Services or related websites. You agree to indemnify, defend and hold harmless SCILIXIR, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against losses, damages, liabilities or claims, including reasonable legal fees payable to a third party, arising from: (1) your breach of these Terms or incorporated documents; (2) your violation of any law or third-party rights; or (3) your access to and use of the Services.

We will notify you of indemnifiable claims; delayed notice does not relieve your obligations unless you are materially prejudiced. We may control their defence and settlement at your expense, including choosing counsel, but will not settle claims requiring non-monetary obligations from you without your consent, which must not be unreasonably withheld. You will cooperate, including by providing relevant documents.

SECTION 18 – SEVERABILITY

If any provision is unlawful, void or unenforceable, it remains enforceable to the fullest extent permitted by law, and the unenforceable part is deemed severed without affecting the validity and enforceability of the remaining provisions.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to exercise or enforce a right or provision is not a waiver. These Terms and policies or operating rules posted on this website or concerning the Services form the entire agreement between you and us, superseding prior or contemporaneous oral or written agreements, communications and proposals, including earlier versions of these Terms. Ambiguities shall not be interpreted against the drafting party.

You may not delegate, transfer or assign this agreement or your rights or obligations without our prior written consent; any attempt is void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

These Terms and separate agreements under which we provide Services are governed by and interpreted in accordance with the federal and state or territorial courts in the jurisdiction where SCILIXIR DERMA ROLLER has its headquarters. You and SCILIXIR DERMA ROLLER consent to the venue and personal jurisdiction of those courts.

You can review the latest version on this page at any time. We may, at our sole discretion, update, change or replace any part by posting updates on our website.
